RezKast believes in Freedom of Speech and the 1st Amendment rights. Some activities, however, can cause serious problems, and therefore are not allowed. RezKast prohibits the use of this site to traffic anything deemed inappropriate by RezKast (this includes, but is not limited to hate, harassment, pornography, and sexual exploitation.
RezKast will not be liable for the content of a user's transmitted information. This content is the sole responsibility of the user. Users are liable for any copyright or trademark violations, or other problems that might arise from the user's content or transmitted information.
Any and all illegal activities such as piracy, cracking, and unauthorized access to our services or any user accounts on our system are forbidden.
RezKast has no obligation to monitor quality and data contents of the Service. However, User agrees that RezKast has the right to monitor the Service and data contents. RezKast will not intentionally disclose any private information to any third party unless required by the laws of the governing authority. RezKast reserves the right to refuse to post and/or to remove any information or materials, in whole or in part, that, in RezKast' sole and absolute discretion, are unacceptable, undesirable, or in violation of this Agreement. RezKast reserves the right to suspend access to the service for user's account.
The e-mail addresses and user information of RezKast subscribers are not for sale for distribution to third parties commercial or otherwise.
Although we perform system backups, we shall not be held responsible for any lost data, files, or other content, regardless of the reasoning for data loss or system causes. User should always keep their own backups of their data.
RezKast shall not be liable for any delay in performance directly or indirectly caused by or resulting from any third party telecommunications providers or public utilities.
Violation of this Policy by a RezKast customer may result in temporary suspension or permanent termination of service at RezKast' sole discretion.
The Coeur d'Alene Tribal courts shall have jurisdiction over this Agreement. Any claim or dispute between you and RezKast that arises in whole or in part from the RezKast site shall be decided exclusively by the Coeur d'Alene Tribal Court located on the Coeur d'Alene Reservation in Plummer, Idaho.
Nothing in this Acceptable Use Policy shall be construed as a waiver or diminishment of the Coeur d'Alene Tribe's inherent sovereign immunity.
The terms of this policy are severable such that if any term or provision is declared by a court of competent jurisdiction to be illegal, void, or unenforceable, the remainder of the provisions shall continue to be valid and enforceable.
RezKast reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
